TREEHOUSE APP RULES
Introduction
- This is the official TreeHouse App (“App”), which has been developed by TreeHouse Foundation and TreeHouse Edutech (Pty) Ltd (together, “TreeHouse” or “we”).
- The App is TreeHouse’s software application and includes all animation and processes.
- By using the App, you agree to our rules for acceptable use of the App. These rules appear in Terms and Conditions, below.
- TreeHouse may change any of its rules, at any time, without notifying you.
- If you have any questions about our rules, please contact TreeHouse.
Terms and Conditions
- Please do not use the App unless you agree to all of TreeHouse’s rules.
- You must be 18 years or older to use the App. If you use the App, you confirm that you are old enough to do so.
- You also confirm that you are legally allowed to process the personal information of any child that you enter in the App.
- To use the App, you have to create a profile and protect it with a password or use an approved social login. You are not allowed to share your password with anyone.
- If you break any of our rules, we have the right to stop you from using the App.
- You use the App entirely at your own risk.
- The App has exercises for you to do with children. You must be careful and act responsibly when you ask children to do these exercises. You must make sure that the children do the exercises in a safe place and guide and supervise the children when using any objects to ensure their safety.
- TreeHouse is not liable or responsible for any injury or loss that you or anyone else may suffer…even if the App has mistakes.
- You indemnify TreeHouse against any liability related to you using the App.
- TreeHouse’s maximum liability to you for all claims for direct damages related to the App is R250.
- TreeHouse will never be responsible for any indirect damages.
- In the App we use intellectual property, like trade marks and copyright, such as software and animated works. This intellectual property is our property. You are not allowed to copy or use our intellectual property unless we give you permission to do so.
- In the App we also use intellectual property that belongs to our third party licensors.
- We or our third party licensors own all rights in the App.
- You are not allowed to use the App, or any of the information on the App, in a way that undermines TreeHouse.
- The App collects your Internet usage information when you access and use the App. This information may be used to identify you if it is put together with other personal information that you give us. It will not be shared with anyone else and it is used only by TreeHouse if necessary. And you agree to this.
- The App also collects your App usage information while you use the App. The reason TreeHouse collects this information is to ensure your personalised journey through the App and, also to improve its services. And, again, you agree to this.
- When this usage information is used for reporting, it will never be used in a way that allows TreeHouse to identify you or (your) children.
- We will only keep you or (your) children's personal information for as long as we need to. We may transfer the personal information outside South Africa to a foreign country.
- We will also collect information that you enter into the App, but this is only for historical (including for AI and machine learning), statistical (including running analytics) and research (and reporting) reasons. This information will never be used to identify you or (your) children.
- The App is hosted on a secure server and uses security measures to prevent interference by intruders.
- The law of South Africa applies to our rules.
- If there is a dispute between you and TreeHouse, then we will first try to end the dispute by mediation and, if that does not work, by arbitration.
- Mediation is when a neutral third party tries to help you and TreeHouse to find a way to end the dispute.
- Arbitration is when a neutral third party listens to you and TreeHouse and then makes a decision about the dispute, which you and TreeHouse will have to obey.
- Any arbitration will be in English and will be in Pretoria, South Africa. The rules of Tokiso Dispute Settlement (Pty) Ltd will be used for the arbitration.
- You or TreeHouse may also apply to court if you need urgent interim relief (temporary help) while the dispute is being resolved.
